Terms of Service

These Terms of Service govern access to and use of the AP Media Growth website, AP Media marketing services and the AP Media AI software platform.
In these Terms, "AP Media", "we", "us" and "our" refer to AP Media Growth and AP Media AI.
"You" and "your" refer to the person or business accessing the website or using our services.
By using our website, purchasing services, creating an account or accessing AP Media AI, you agree to these Terms.
1. Our Services
AP Media may provide services including:
- digital marketing
- content creation
- advertising strategy and management
- SEO research and optimisation
- website content
- social-media content
- reporting and analytics
- AI-assisted content generation
- client knowledge storage and retrieval
- article generation and publishing
- third-party integrations
- other agreed marketing or software services
The exact scope, price, term and inclusions of a paid service may be described in a separate proposal, order, statement of work, subscription page or written agreement.
2. Account Eligibility
You must be at least 18 years old and legally capable of entering into a contract.
You must provide accurate account and business information.
You are responsible for:
- protecting your login details
- activity conducted through your account
- promptly notifying us of unauthorised access
- ensuring authorised users comply with these Terms
You must not share account access with unauthorised parties.
3. Client Responsibilities
You are responsible for:
- providing accurate information
- reviewing content before approval or publication
- maintaining necessary licences and permissions
- ensuring uploaded information is lawful
- obtaining consent to record and upload interviews
- ensuring you have rights to uploaded documents, images, audio and other content
- complying with advertising, privacy, intellectual-property and industry rules
- checking factual, legal, financial, health or technical claims before publication
- maintaining access to connected websites and third-party platforms
AP Media is not responsible for problems caused by incorrect, incomplete or outdated information supplied by you.
4. Client Content
You retain ownership of content and information you provide to AP Media, subject to any third-party rights.
You grant AP Media a limited licence to host, copy, process, analyse, transform and use your content only as reasonably necessary to:
- provide the services
- operate AP Media AI
- generate requested outputs
- publish approved content
- maintain security
- troubleshoot issues
- comply with legal obligations
You represent that you have the rights and permissions necessary to provide and use the content.
5. Business Brain and Knowledge Sources
AP Media AI may store client-provided websites, URLs, documents, notes, images, audio, transcripts and other information in a client-specific knowledge database known as the Business Brain.
The Business Brain may be used to retrieve relevant information for:
- articles
- social-media content
- answers
- SEO recommendations
- marketing strategies
- reports
- other generated outputs
You are responsible for reviewing whether information stored in the Business Brain remains accurate, current and approved for use.
Restricted, confidential or outdated information should be identified and managed through available platform controls or by contacting AP Media.
6. AI-Generated Content
AP Media AI uses automated and artificial-intelligence systems.
AI-generated content may:
- contain inaccuracies
- omit relevant information
- require editing
- resemble publicly available material
- be unsuitable for particular industries
- require professional review
You must review and approve generated content before relying on or publishing it.
AP Media does not guarantee that AI-generated outputs will:
- be error-free
- achieve particular rankings
- generate leads or sales
- comply with every industry-specific rule
- be suitable as legal, financial, medical or other professional advice
7. SEO and Marketing Results
SEO, advertising and marketing performance is affected by factors outside AP Media's control, including:
- search-engine algorithms
- market competition
- website quality
- client approvals
- advertising budgets
- platform policies
- customer behaviour
- third-party systems
- economic conditions
We do not guarantee:
- first-page Google rankings
- a specific ranking position
- a specific number of leads
- sales or revenue
- advertising approval
- search indexing
- uninterrupted traffic growth
Any forecasts or opportunity scores are estimates and not guarantees.
8. Third-Party Services
Our services may connect with third-party platforms including:
- Meta
- website platforms
- hosting providers
- analytics providers
- artificial-intelligence providers
- payment processors
Third-party services are governed by their own terms, policies, availability and limitations.
We are not responsible for:
- outages
- account suspensions
- API changes
- lost access
- platform policy changes
- third-party security incidents
- changes to third-party pricing
- content removed or rejected by a third party
9. Google API Services
Where you connect Google services, you authorise AP Media AI to access the Google data covered by the permissions you approve.
AP Media AI will use Google data only to provide the connected functionality.
You may revoke access through your AP Media AI account or your Google account.
Your use of Google services is also subject to Google's applicable terms and policies.
10. Fees and Payment
Fees are specified in the relevant subscription, proposal, invoice, order or written agreement.
Unless otherwise stated:
- prices are in Australian dollars
- GST will be applied where required
- subscriptions are billed in advance
- invoices must be paid by their due date
- third-party advertising spend is separate from AP Media fees
- third-party software or integration costs may be charged separately where agreed
Failure to pay may result in suspension or termination of services.
11. Subscriptions, Cancellation and Renewal
Subscription periods, renewal arrangements and cancellation requirements will be shown at the time of purchase or in the applicable agreement.
Where a subscription renews automatically, the renewal terms and applicable fees must be clearly disclosed.
You may cancel in accordance with the applicable subscription or service agreement.
Cancellation does not automatically entitle you to a refund for services already supplied, subject to rights that cannot lawfully be excluded.
12. Refunds and Consumer Rights
Refunds are assessed according to:
- the services purchased
- work already completed
- third-party costs incurred
- the applicable proposal or subscription
- Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
13. Acceptable Use
You must not use the website or platform to:
- break any law
- infringe intellectual-property rights
- upload content you do not have permission to use
- distribute malicious software
- gain unauthorised access
- interfere with platform security
- scrape or reverse engineer the platform except where legally permitted
- generate fraudulent, misleading, defamatory or harmful content
- impersonate another person
- submit sensitive information without appropriate authority
- use the service to spam or harass others
- overload or disrupt the platform
- attempt to access another client's information
14. Intellectual Property
AP Media retains ownership of:
- the AP Media AI platform
- platform software and code
- system architecture
- branding
- templates
- workflows
- proprietary prompts
- scoring systems
- Business Brain technology
- documentation
- improvements to the platform
Unless otherwise agreed, you receive a limited, non-exclusive and non-transferable right to use the platform during your active subscription.
Ownership of custom deliverables may be addressed in the applicable service proposal or agreement.
15. Confidentiality
Each party must use reasonable care to protect confidential information received from the other party.
Confidential information does not include information that:
- is publicly available through no breach
- was already lawfully known
- is received lawfully from another source
- is independently developed
- must be disclosed by law
16. Service Availability
We aim to provide reliable services but do not guarantee uninterrupted or error-free access.
We may:
- perform maintenance
- update features
- modify integrations
- suspend access for security
- correct errors
- discontinue features where reasonably necessary
Where practical, we will provide notice of material service changes.
17. Suspension and Termination
We may suspend or terminate access where:
- fees remain unpaid
- these Terms are materially breached
- use creates security or legal risk
- you misuse the platform
- a third-party integration requires suspension
Where reasonable, we will provide notice and an opportunity to remedy the issue.
You may stop using the service or cancel in accordance with the applicable agreement.
18. Data After Termination
Following termination, access to the platform and stored information may end.
You should export any information you require before termination.
We may retain or delete information in accordance with our Privacy Policy, legal obligations and operational requirements.
19. Liability
To the maximum extent permitted by law, AP Media is not liable for indirect, incidental, special or consequential losses, including loss of profits, revenue, goodwill, opportunity or data.
Where our liability cannot lawfully be excluded, it will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes liability or rights that cannot legally be excluded under Australian law.
20. Indemnity
To the extent permitted by law, you are responsible for loss or claims arising from:
- content you provide
- your unlawful use of the services
- infringement of third-party rights
- your breach of these Terms
- your failure to obtain necessary permissions
This clause does not apply to the extent a loss was caused by AP Media's negligence, unlawful conduct or breach.
21. Changes to These Terms
We may update these Terms to reflect changes to:
- services
- technology
- legal requirements
- third-party integrations
- business operations
The updated version will be published on this page with a new revision date.
Material changes affecting active paid subscriptions will be communicated where reasonably required.
22. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the courts and tribunals with jurisdiction in New South Wales, subject to any applicable consumer-protection rights.
